Risk of Loss

All items purchased from Potter & Potter Auctions are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Streaming Content

Stream Content will generally continue to be available to you for streaming from your personal account at potterauctions.com as applicable, but may become unavailable due to potential content provider licensing restrictions and for other reasons, and Potter & Potter Auctions will not be liable to you if purchased Streaming Content becomes unavailable for further streaming.

Unauthorized Activities

Potter & Potter Auctions does not monitor your data or transmissions, yet, Potter & Potter Auctions does actively monitor accounts for system utilization. However, you agree that, in Potter & Potter Auctions' efforts to promote good citizenship within the Internet community, if Potter & Potter Auctions becomes aware of inappropriate use of the Site or any Potter & Potter Auctions service, Potter & Potter Auctions may respond. You acknowledge that Potter & Potter Auctions will report to law enforcement authorities any actions which may be considered illegal, as well as any reports it receives of such conduct. When requested, Potter & Potter Auctions will cooperate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.

If you violate these Terms, Potter & Potter Auctions reserves the right to terminate your ability to use the Site without notice. In addition, you agree to terminate your use of the Site upon request. Potter & Potter Auctions’ preferred course of action is to advise you of your inappropriate behavior and recommend any necessary corrective action.

You agree that Potter & Potter Auctions can revise these Terms at any time without notice by updating this posting on the Site. You agree that your continued use of the Site after such modifications have been made constitutes your acceptance of such revised Terms.

Any action related to these Terms will be governed by Arizona law and controlling U.S. federal law, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree to submit to the jurisdiction of the courts located in the State of Arizona, for the resolution of all disputes arising from or related to these Terms and/or your use of the Site.

If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of Potter & Potter Auctions to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Potter & Potter Auctions in writing. The Terms comprises the entire agreement between you and Potter & Potter Auctions and supersede all prior or contemporaneous negotiations, discussions or agreements, if any, between the parties regarding the subject matter contained herein.

Potter & Potter Auctions reserves the right to make changes to this Agreement at any time. Your continued use of the Service following any such changes will constitute your acceptance of such changes.

Supplementary Terms and Conditions Regarding Autographs

When a buyer has had (1) the opportunity to view auction lots in person, (2) a lot is comprised of three or more items, or (3) a lot if accompanied by a third party Certificate of Authenticity, buyer has no right of return.

On lots not within the above three categories, and within 3 days of receipt of item, buyer may notify Potter & Potter of their intention to seek written authentication at their expense from two recognized experts in their field acceptable to Potter and Potter.

Any lot on which both experts agree on a lack of authenticity must be returned to Potter and Potter within 30 DAYS of the auction date. AFTER THIS 30 DAY PERIOD, NO LOT MAY BE RETURNED FOR ANY REASON. Lots returned must be in the same condition as they were sold and must include any certificate of authenticity.

All other terms and conditions as printed in the catalog and posted online remain in full force and effect.
